These terms apply to your use of the Site and to orders you place through it. By using the Site you agree to these terms. If you do not agree, please do not use the Site. Nothing in these terms affects your statutory rights as a consumer.
2. What we do — and what we don't
We are a comparison and introduction service. We display prices offered by third-party recycling companies ("Recyclers") for mobile phones and other devices, and we let you place an order with your chosen Recycler through our checkout.
When you place an order, your contract for the sale of your device is with the Recycler, not with us. The Recycler is responsible for receiving your device, assessing it, paying you, and returning it where applicable, under its own terms and conditions, which we show or link to before you complete your order. We are not a party to that contract and do not buy devices ourselves.
3. Using the Site
You must be at least 18 years old and resident in the United Kingdom.
You must own the device you are selling, or have the owner's authority to sell it, and it must not be lost, stolen, counterfeit, or subject to outstanding finance that prohibits its sale.
You must provide accurate information, including an honest assessment of your device's condition against the descriptions shown during the quote process.
You must not use the Site fraudulently, to harvest data, or to interfere with its operation.
4. Quotes and pricing
Prices shown on the Site are supplied to us by Recyclers via live data feeds. We take care to display them accurately, but the price paid to you is set by the Recycler, not by us.
A quote is based on the device details and condition you select. Quote validity periods are set by each Recycler and shown before you order.
When the Recycler receives your device it will inspect it. If its assessed condition differs from what you selected, the Recycler may revise the offer. You can accept the revised offer or reject it, in which case the Recycler will return your device in line with its terms (most return devices free of charge, but this is set by the Recycler).
5. Sending your device
Postage or collection options (e.g. freepost label, prepaid postage bag, courier collection, drop-off) are provided by your chosen Recycler and described at checkout.
Package your device securely and follow any instructions provided. Responsibility for the device in transit is governed by the Recycler's terms and the postage method chosen.
Send only the device and any items requested. Remove SIM and memory cards before posting — neither we nor the Recycler are responsible for them or for any charges arising from a SIM left in a device.
6. Your data on the device
Before sending your device, you are responsible for backing up anything you want to keep and performing a factory reset to remove your personal data, accounts and activation locks (e.g. Find My iPhone / iCloud, Google account / FRP).
Recyclers will typically wipe devices on receipt, but neither we nor the Recycler are responsible for data left on a device or for any loss of data, so far as the law allows.
7. Payment
Payment for your device is made by the Recycler, using the details you provide at checkout, after it has received and assessed your device and you have accepted any revised offer. Payment timescales are set by each Recycler and shown on the Site. If a payment is late or disputed, contact us and we will help you resolve it with the Recycler, but responsibility for payment rests with the Recycler.
8. Our liability
We provide the Site with reasonable care and skill, but we do not guarantee it will be uninterrupted or error-free, or that prices displayed will always be available from the Recycler.
We are not liable for the acts or omissions of Recyclers, including assessment decisions, revised offers, returns, lost devices, or payment — these are matters between you and the Recycler under your contract with them, though we will assist where we reasonably can.
We are not liable for loss of data stored on devices, or for indirect losses such as loss of profit or opportunity.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Where we are liable to you, our total liability in connection with your use of the Site is limited to £100 or the quoted value of the relevant order, whichever is higher.
9. Referrals, commission and partner sites
We may receive commission from Recyclers when you complete a sale through the Site. If you arrived via a partner site (such as a price comparison or cashback site), that partner may also receive commission and we may confirm your order completion to them for that purpose. Commission does not affect the price you are paid, which is set by the Recycler.
10. Intellectual property
The Site and its content — including the sellmobilephones.com name, logo, text, graphics and software — are owned by or licensed to us and protected by intellectual property laws. You may use the Site for personal, non-commercial purposes only. Recycler names and logos belong to their respective owners.
11. Complaints
If something goes wrong, contact us at support@sellmobilephones.com and we will do our best to help, including liaising with the Recycler where the issue relates to your sale. Complaints about a Recycler's assessment, payment or returns should also be raised with the Recycler directly under its complaints process.
12. General
We may update these terms from time to time; the version in force when you place an order applies to that order.
If any part of these terms is found unenforceable, the rest remain in effect.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction (if you live in Scotland or Northern Ireland, you may also bring proceedings there).
